When two or more vehicles collide, a frequent question is, which driver is responsible for the collision? There is sometimes a third culprit these types of multiple car accident (or even a single car accident) city, county, state municipal and other agencies (perhaps private toll road or bridge) are responsible for building, designing and maintaining the road that drivers use and using funds properly to execute proper road procedures. In some case there can be another victim that can be found that also compounds your case (but another victim is not necessary to win a case).

Things to be examined:

Proper installation or upgrade for a traffic control device or other safety features that was called for?

Was it a blind intersection or crosswalk?

Missing guardrails?

Improper drainage?

Obstructed or missing warning sign?

Too-sharp of a curve, high posted speed limit or other driving issue ignored by officials?

Has there been a formal request to fix this problem previously and it has been ignored before you were in an accident
Problems with the road  concrete (example, potholes) construction which causes a driving hindrance?

If an accident is partly due to your own fault, you can still recover from the party that was primarily responsible for your injuries. However, the amount of your recovery will be reduced under what is called 'comparative negligence', or 'comparative fault'. The opposing party's carelessness is compared to yours, and that determines the percentage of liability and compensation is calculated accordingly.
